Battery Waste Management Rules 2022: What They Mean on the Yard Floor

A practical guide to India's Battery Waste Management Rules 2022 for recyclers: why it is separate from e-waste, what EPR means downstream, records, and safe intake.

The load that does not fit your existing categories

A three wheeler fleet operator calls. He has forty end of life traction packs sitting behind his workshop and wants them gone this week. Your yard already handles lead acid batteries, so the assumption on both sides is that this is the same trade with a different chemistry.

It is not. The moment a lithium ion pack crosses your weighbridge, you are in a different regulatory regime, with a different registration, a different set of records, and a different fire risk profile than anything else on your site. Yards get into trouble here not because they are careless but because they treat batteries as one more scrap category in a system that was never asked to track them separately.

This post is about the operational consequences of the Battery Waste Management Rules, 2022 for a recycler: what regime you are actually in, where you sit in the EPR chain, what records you have to be able to produce, and what safe intake and storage look like when the material is arriving on a tempo at 6pm on a Saturday.

A note before anything else. This is an operations note, not legal advice. The rules have been amended more than once since notification and thresholds, recovery targets and timelines change. Confirm the current text and your specific obligations with your consultant or your State Pollution Control Board before you commit to anything.

Batteries are a separate regime from e-waste

The single most common error is assuming that if you already hold an e-waste recycler registration, batteries are covered.

The Battery Waste Management Rules, 2022 sit under the Environment (Protection) Act and superseded the older battery rules that covered mainly lead acid. They apply broadly across battery types, including electric vehicle batteries, portable batteries, automotive batteries and industrial batteries, irrespective of chemistry, shape or use. The E-Waste (Management) Rules cover listed electrical and electronic equipment and are administered as their own scheme.

The practical consequences:

  • Separate registration. Being a registered e-waste recycler does not authorise you to recycle waste batteries. The registration category, the application and the conditions attached to it are distinct.
  • Separate reporting. Battery returns are filed against the battery scheme. Do not fold battery tonnage into e-waste returns to make the numbers tidy.
  • Separate certificate pool. EPR certificates generated from battery recycling are recognised under the battery scheme. They are not interchangeable with e-waste credits.
  • Mixed streams need a decision at the gate. A laptop with an embedded pack, a power tool, an e-rickshaw controller with a pack attached: your intake process has to decide what is being received as which stream, and record it that way from the first weighment. Retrofitting the split later is guesswork.
Hazardous waste handling and transport rules also continue to apply alongside, particularly for damaged or leaking cells. The battery rules do not replace them.

Where a recycler sits in the EPR chain

Extended Producer Responsibility puts the obligation on the producer. A producer who places batteries on the market carries a responsibility to see that an equivalent quantity is collected and sent for recycling or refurbishment, with minimum recovery expectations that step up over time.

Producers cannot discharge that obligation by paying a collector. It is discharged when material actually reaches a registered recycler and is actually processed, and when the certificates evidencing that processing are generated on the centralised online portal and transferred to the producer.

That makes you, the recycler, the point where the obligation becomes real. Two things follow.

First, your registration is the product. Producers and their aggregators will not send volume to an unregistered yard, because the material would generate no certificate and would not count against their target. Registration is not a compliance overhead sitting on top of the business. It is the reason the material comes to you at all.

Second, your processed quantity is the currency. Certificates are tied to the quantity of waste battery material you actually recycle and the material you recover, not to what arrived at your gate. Received tonnage and processed tonnage are different numbers, and the gap between them is where disputes live. If a producer or an auditor questions a certificate, the question will be some version of: show me that this quantity came in, and show me that this quantity was processed in this period.

Do not treat certificates as a bookkeeping side task. Understand that generation and transfer happen on the portal against your registered capacity, and that overcommitting against capacity you do not have is the fastest way to lose a registration.

Quantities by period are the core record

Everything above reduces to one operational requirement: you must be able to state, for any period, how much waste battery material you received, from whom, by category, and how much you processed.

That is harder than it sounds in a yard that runs on weighbridge slips and a ledger. Consider a yard that takes in mixed lithium ion in a month. An illustrative picture of the record you need:

Three things make this record hold up.

Opening plus received minus processed equals closing. If that identity does not hold for every category in every period, you have either an unrecorded receipt, an unrecorded process output, or a category that moved without a document. Run the check monthly, not at year end.

Category and chemistry are captured at intake, not inferred later. A pack weighed in as "battery scrap" cannot be split into EV, portable and industrial six months on. Your intake categories should mirror the categories you have to report against, even where that feels over-precise on the yard floor.

Every movement carries a document reference. Supplier, vehicle, weighment, photographs of the load, the internal batch or lot the material was assigned to, and the output lots that came from it. When someone challenges a quantity, you are producing a chain, not an assertion.

The same discipline serves you commercially. Traceable quantities are what let you price contracts against certificate value rather than against scrap value alone.

Safe intake and storage at yard level

Lithium ion changes the risk profile of your site. A damaged cell can go into thermal runaway with no external ignition source, can reignite hours after it appears to be out, and does not care that the rest of your yard is steel.

At the gate

  • Refuse to accept anything as an anonymous mixed load. Chemistry and format go on the ticket.
  • Photograph the load at weighment. It is your only evidence of condition on arrival if a pack fails later.
  • Inspect for swelling, deformation, burn marks, electrolyte odour, leakage and crushed casing. Anything showing these signs is damaged or defective material and needs to be handled and, if it moves again, packaged to a stricter standard than intact cells.
  • Tape or cap exposed terminals before the material goes anywhere. Loose conductive scrap in the same bin as an uncapped cell is a short circuit waiting for a bump.
  • Treat high voltage EV packs as live until a trained person has confirmed otherwise. Pack level work belongs to trained staff with insulated tools and appropriate PPE, not to whoever is free.

In storage

  • Store batteries in a dedicated area, not against the boundary wall of the shed and not next to the oil drums or the baled paper.
  • Keep intact material at a partial state of charge where you can influence it. Fully charged storage carries more stored energy for no benefit.
  • Quarantine damaged and suspect units separately, in non combustible containers, with separation distance from the main stock and from each other.
  • Keep the area dry and out of direct sun. Heat and water ingress are both accelerants for problems you will not see until they are large.
  • Do not stack packs to the roof to save floor space. Height turns a single cell event into a pile fire.
  • Agree your suppression approach with a competent fire consultant and make sure the yard team knows what it is before they need it. Have inert absorbent, thermal gloves and an evacuation line marked, and treat any smoking or venting unit as a site evacuation, not a fire to fight.
  • Cap dwell time. Waste batteries are not a commodity to hold for price. The longer they sit, the more risk you carry for the same margin.

On dispatch

Damaged, defective and intact cells travel under different conditions. Confirm the packaging and documentation requirements for the specific material with your transporter before booking, and make sure the driver is carrying the manifest and the emergency information, not just the invoice.

What this looks like in a system

The record described above is not exotic. It is the same shape as any yard's inventory ledger, with three extra requirements: category granularity that matches the reporting categories, photographic and document evidence attached to each movement, and a monthly reconciliation between received, processed and on hand.

Do I need EPR registration if I only collect and dismantle lithium-ion batteries, not smelt them?

Yes. Under the Battery Waste Management Rules, 2022, recyclers and refurbishers must register with the Central Pollution Control Board on its EPR portal regardless of whether they run downstream metallurgical processes. Registration is tied to the role you play in the battery waste chain, not to the technology used. Collection, dismantling, storage and preprocessing all fall inside the regulated recycler role, and unregistered entities cannot issue valid EPR certificates.

What is an EPR certificate and how does it actually get generated?

An EPR certificate is a digital credit generated on the CPCB portal when a registered recycler reports a verified quantity of battery waste recycled, and it can be transferred to producers to offset their recycling obligations. Generation depends on the recycler filing returns with quantities of input waste and recovered material, within the recovery limits allowed for the battery chemistry. Producers buy these certificates to demonstrate compliance.

What records should a lithium-ion recycling plant keep to survive an inspection?

Keep an auditable chain from inbound weighment to recovered output. That means dated inward records with supplier identity and battery chemistry, weighbridge or scale tickets, transport documents, internal movement between dismantling and processing, mass balance showing input versus recovered metals and residues, hazardous residue disposal records with the authorised handler, and copies of portal filings. Inspectors typically test whether physical stock, ledgers and portal returns reconcile.

Can I mix lead-acid and lithium-ion battery waste in the same storage and reporting stream?

No. The rules treat battery types as distinct categories, and EPR obligations, recovery expectations and certificate generation are tracked per battery type. Mixing them breaks your mass balance, creates real safety hazards since lithium cells can undergo thermal runaway, and makes portal filings impossible to defend. Segregate at inward stage, label storage areas by chemistry, and keep separate ledgers and returns for each category.

Who is responsible if a producer misreports and my recycler certificates are cancelled?

The recycler bears direct consequences even when a producer misreports, because certificates trace back to the recycler that generated them. Regulators can cancel or claw back certificates linked to unverifiable quantities, and repeated discrepancies can affect the recycler's registration. Practically, this means verifying counterparties, retaining the underlying weighment and processing evidence for every certificate issued, and reconciling portal balances before any transfer is executed.
